What Happens If a Property Chain Breaks?
If you’re buying or selling a home, you’ve probably heard of the term “property chain” and are possibly worried about what happens if it breaks.
Here’s what you need to know, and how a good conveyancing team can help protect you.
What Is a Property Chain?
A property chain is a sequence of linked property transactions, where each sale depends on the next. For example:
You’re selling your house to a buyer, who is selling their house to someone else, who is buying from someone else and so on.
For a property transaction to proceed, everyone in the chain needs to be ready to exchange contracts and complete at around the same time. However, if an issue arises with one of the properties in the chain, this can cause delays for everyone involved and, in some cases, may mean that a buyer is no longer able to proceed. In this instance, the chain would break.
What Does It Mean for a Chain to “Break”?
A chain breaks when one party pulls out of their transaction before exchange of contracts, causing a knock-on effect for everyone else linked to that sale.
Common Reasons Chains Break
- Buyer’s mortgage falls through – lender declines the application or valuation comes in low
- Cold feet – a buyer or seller changes their mind
- Survey problems – issues uncovered that the buyer isn’t willing to accept
- Failed searches – something concerning turns up (see our post on common searches)
- Death or serious illness in the chain
- Delays causing frustration – someone finds another property and walks away
- Gazumping – a seller accepts a higher offer from someone else
What Happens Next?
If you’re selling and your buyer pulls out: Your own purchase (if you have one) may now be at risk too, since you may no longer have the funds to proceed. You’ll need to find a new buyer and negotiate a delay with the person you’re buying from as they may be happy to wait to save finding a new buyer themselves.
If you’re buying and your seller pulls out: You will need to find another property that you would like to buy. Any money spent on searches, surveys, or legal fees up to that point is typically not refundable
If the chain breaks on a different property: You will need to wait until the chain is complete again to be able to complete on your sale and purchase or alternatively decide to find a new property to buy or find a new buyer.
Important: Before exchange of contracts, a sale or purchase is not legally binding. This is why chains are vulnerable up until that point.
Can a Solicitor Prevent a Chain From Breaking?
Not entirely but the right conveyancer can significantly reduce the risk by:
- Communicating proactively with all solicitors in the chain
- Flagging problems early – ordering searches promptly and reviewing survey results quickly
- Coordinating a realistic exchange and completion date that works for everyone
What Should You Do If Your Chain Breaks?
- Stay calm and contact your solicitor immediately – they can advise on your options
- Assess your finances – can you proceed without the sale/purchase that fell through?
- Consider your alternatives – renting temporarily, bridging finance, or re-marketing your property
- Don’t panic-sell or panic-buy – rushed decisions often lead to bigger problems
Wait – the chain most likely will be completed again and your purchase and sale will complete.
How to Reduce the Risk from the Start
- Use a proactive, responsive solicitor (not just the cheapest one)
- Get a mortgage agreement in principle early
- Instruct your solicitor as soon as your offer is accepted, not weeks later
- Ask your estate agent about the buyer’s position (chain-free, cash buyer, etc.) before accepting an offer
